The safe harbor date had passed. The Election was lost. Eastman’s bizarro legal theory that the Vice President can throw out electoral votes and pick the winner is not something rooted in reality

As were Democrats when they pushed through two impeachments in the House that they knew would fail in the Senate. Remember Pelosi handing out her prized impeachment pens and the pompous March of Democrats to the Senate?
Times are much more critical after a year of Biden, so hopefully Republicans won’t do something silly like that.

There was potential for EC votes yo be challenged. The media do not declare the result of a presidential race. The EC certifications can be challenged. It’s not over till it’s over constitutionally.

It is the States that verify the electors.

The Electors have a legal obligation to cast the vote for the candidate that they are tied to or face punishment.

Who is or isn’t in the Electoral College is irrelevant since they are empowered by the individual states to cast their votes as directed.

At which point the election result was legally “decided”. There was no election “decision” or “result” before that point. So any legal actions taken to affect the up-coming EC decision cannot be an attempt to overturn the as yet non-existent decision.

Then why were Democrats before the election exhorting EC delegates to go rogue and consider splitting their state’s votes proportionally to the relative votes of the candidates. Were they inciting an insurrection and the overthrow of an election?

Probably the same as Democrats. Only ones they appear to have lost. It would be stupid to contest one you thought you had fairly won.
