He was arrested and detained because he is a member of an FTO (MS-13) and is in this country illegally. A temporary work permit doesn’t mean someone can’t legally be detained as an illegal alien.

If you have “Temporary Legal Status”, ya you are here legally.

If you remain after the TLS is removed you are illegal.

Until such time as the Government exercised 8 USC 1231 to deport to a 3rd party country that agreed to take Abrego Garcia. Then the government could get the hold lifted and deportation could continue.

However the Administration in 2019 chose NOT to pursue 3rd country deportation and decided to issue legal work authorization.

The hold was only for El Salvador.

That was then and this is now.

He was arrested as a member of an FTO. Once MS-13 was designated as an FTO, it was only a matter if time before Garcia was arrested.

MS-13 is not a “foreign” anything.

And denied due process to make a case that he wasn’t.
