Of course it was. ES could have chosen to incarcerate or not. They chose to incarcerate. In scenario 1 the US wouldn’t have deported to ES if they weren’t planning to incarcerate.
Well, yeah, but you keep showing support for ignoring the constitution, and people keep calling you out on that. Which I think is right. No matter how many times someone posts support for ignoring the constitution, that has to be called out. Every time. Otherwise the gaslighting authoritarians win.
Everything being done by the administration in regard to illegal aliens has been constitutional. Just because forum LIBs call their actions unconstitutional doesn’t make it so. Continuing to claim their actions are unconstitutional, without providing any supporting evidence, is simply a recitation of LW talking points.

As a recent example, someone - who will remain nameless - in addition to flatly stating he would never be returned to the US, indicated that once Abrego Garcia is released from TN on bond, that ICE will arrest him and deport him.
I on the other hand, predicted that Abrego Garcia’s lawyers would file for him to be returned to Maryland before Judge Xinis which is where is immigration case is. That was PRIOR to their emergency motion of June 26. Of course we still have to see how that plays out for the Judge, motions are scheduled and there is a hearing July 7th.
