It is long settled precedent that Representatives and Senators are NOT subject to the impeachment process. They are subject only to the much simpler process of expulsion.
The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.
Civil Officers do NOT include Representatives or Senators. It does include principle officers and inferior officers. It does not include mere employees. Interestingly, any commissioned military officer could be subject to impeachment. Enlisted personnel could not be subject to impeachment. Career civil servants, whether on the General Schedule or in the Senior Executive Service would not be subject to impeachment.
My sister is a lawyer we talked about this at dinner today. She agrees congress members do not rise to the level of impeachable no matter what they do. Romney could shoot someone on 5th Avenue…and they could not impeach him!
So Trump wants the Democrat controlled House of Reps to impeach a Senator who quite probably would vote in favour of finding Trump guilty in a Senate trial of Trump. Does anyone see a flawin Trump’s thought process?
