Exactly. They would still be detained pending an asylum hearing but they would not be facing prosecution for illegal entry.

Thatā€™s what ā€œzero toleranceā€ means, everyone who enters the country illegally whether they request asylum or not is facing charges for illegal entry.

So in the cases where the government doesnā€™t let them come in at an official checkpoint when these families have requested because the govt is screwed up itā€™s not the familiesā€™ fault. Itā€™s the government. They wanted to obey the law. They shouldnā€™t be penalized.

Durbin was on the tube minutes ago attacking the EO. The man was clearly angry at the prospect of losing a campaign issue rather than children being separated.

Uh, no. This is the logical extension of the (incorrect in my view) ruling by the Supreme Court in Hosanna-Tabor Evangelical Lutheran Church. Church law can impose discipline against its members even if that discipline is otherwise prohibited by a law of general application. You will remember that in that case, a church member and employee filed an EEOC complaint instead of using the Church law procedure, and was fired. The Court held that the generally applicable anti-retaliation provisions could be be used against the church because the filing was prohibited by Church law. If Jeff Sessions violates the tenets of his church, he can receive Church discipline.

But to address your scenario, people who come to Official entry points with a legitimate request for asylum are being let in with their children, but it takes time to process them, and there are too many to usher in without delay, so some have waited days for their turn to be sorted out from those whoā€™s claims are invalid. However, not wanting to wait and so instead crossing illegally does not constitute ā€œwanting to obey the law.ā€ That is not an excuse for them to not be penalized.

Obama had eight years to fix it. Whatā€™s your excuse for that?
