Why would the US want to bring back an illegal MS 13 gang member? Yes, there was a mistake, but I seriously doubt any administration official will lose any sleep over it.
The articles I read said exactly that. He was only protected from deportation to his home country. He could have been deported elsewhere, but it gets complicated when trying to deport someone to a country other than their country of origin.
We can send a Venezuelan back to his home country. They kind of have to take him or risk Trump’s rath. But we really can’t send that Venezuelan to a country like Columbia unless they agree to take him. We don’t have much legal recourse to force them to take him.
El Salvador and CECOT are a whole different story. They are very receptive to taking our illegal gang members, regardless of where they came from. For a price of course. Money talks.
I’m still waiting for Allan to respond to THIS POST in which I wrote:
Well, once again you deflect from the fact that a subversive judge has used their office of public trust to issue a TRO, based on a written opinion which misrepresents legislative intent to arrive at the erroneous conclusion justifying the TRO.
As I previous pointed out to you, adhering to legislative intent certainly does matter.
in Hawaii v. Mankichi, 190 U.S. 197 (1903) our Supreme Court indicated:
“A thing may be within the letter of a statute and not within its meaning, and within its meaning, though not within its letter. The intention of the lawmaker is the law.”
Our Supreme Court has also instructed that:
The whole aim of construction, as applied to a provision of the Constitution, is to discover the meaning, to ascertain and give effect to the intent of its framers and the people who adopted it._____HOME BLDG. & LOAN ASSOCIATION v. BLAISDELL, 290 U.S. 398 (1934)
So, again I ask you, why are you ok with Judge Henderson ignoring the legislative intent of the Alien Enemies Act and obstructing the President’s authority under the Act?
Why are you ok with Judge Henderson nullifying our last federal election and the people’s guaranteed right to vote for change of existing public policy, and judge Henderson nullifying the will of the people by subverting our system‘s rule of law requiring legislative intent to be adhered to?
An immigration judge eventually granted Abrego Garcia withholding of removal, meaning he could suffer persecution if removed from the US to El Salvador. He was still considered removable; it just couldn’t be to El Salvador.
Like I said trump gave him a protected status and trump removed his protection status. Fact is he was sent back to the country he lived in before he illegally entered the United States. Looks to me like he is home. No need to get him back.
Biden and every woke leftist have everything to do with trumps EO to clean up the mess biden and every one of his supporters caused. I guess you can’t argue with facts, so you resort to a longstanding woke prog trick blame someone else for your mess.
