Why did Cuomo Send C-19 Patients to Nursing Homes?

Sadly it appears this was just part of his “plan” going back to his refusal to buy badly needed ventilators back in 15/16.

Just call it part of the Triage System. The old and infirm have the least life left to live so he just put a black X on their foreheads and sent them home with body bags so as to keep the limited resources for those with the most life left to live.

Gov’t healthcare at it’s “best”.

It’s just their training and the world of defensive medicine they have to operate in.

The mean well and know their stuff but like most true experts have a very limited focus and don’t go outside of their field.

This outbreak has given us a real window to see into the future.

Democrats could not wait to use this outbreak to expand their power far beyond anything allowed by our constitutions and for the most part they are the “leaders” who most loathe returning power back to The People now that the crisis is past.

That doesn’t answer the question as to why you would send infected patients where they would do the most harm.

NH’s are not conducive to quarantining contagious patients, they are completely ill equipped to do so.

The Governor ordered them to be sent back to NH’s instead of quarantined in Hospitals where they belonged.

Worse, he barred NH’s from even requiring a negative test and keep infected staff working in the NH’s.

Actually you do. Public Health laws allow for quarantine of people who are carrying a communicable disease.

This isn’t about what the residents wanted to do, it’s about what the government ordered Nursing Homes to do.

You’re right. A nursing home that take 10k a month from a resident cannot bar them from their home. That is their mailing address, statist.

Not really. You just can’t fathom the fact that covid patients have a right to return home, whether it is a ranch or room at a home.

They don’t have any such right when doing so endangers everyone else in the facility.

This is why NY leads the entire country and most of the world in deaths from this outbreak.

Nursing homes are the most vulnerable location and population of all with the highest concentration of those at highest risk of death from this disease.

Quarantines of people with communicable diseases have been upheld at every level of the courts for more than a century.

In this case the exact opposite was enacted by the Governor of NY who’s actions directly led to the deaths of thousands.

Is Quarantine Constitutional?

The federal government derives its authority for isolation and quarantine from the Commerce Clause of the U.S. Constitution.

Per Section 361 of the Public Health Service Act (42 U.S. Code § 264), the U.S. Secretary of Health and Human Services (HHS) is authorized to take measures to prevent the entry and spread of communicable diseases from foreign countries into the United States and between states.

The authority for carrying out these functions on a daily basis has been delegated to the Centers for Disease Control and Prevention (CDC)

Per Section 42 Code of Federal Regulations parts 70 and 71, CDC is authorized to detain, medically examine, and release persons arriving into the United States and traveling between states that are suspected of carrying communicable diseases.

As part of its federal authority, CDC routinely monitors persons arriving at U.S. land border crossings and passengers and crew arriving at U.S. ports of entry for signs or symptoms of communicable diseases.

When alerted about an ill passenger or crew member by the pilot of a plane or captain of a ship, CDC may detain passengers and crew as necessary to investigate whether the cause of the illness on board is a communicable disease.
