The court of public opinion means a lot. That is the court that decided the opinion of the NYC court and official decision that Trump was a felon 34 times over was garbage. That is the court that made him our President again.
An Obama appointed judge had ruled that Trump could not remove the temporary protected status of 300k Venezuelans basically because she disagreed with the decision to do so even though the law creating this status leaves the decision up to the President.
Today, the Supreme Court reversed this decision, leaving TPS up to the President.
Judge Jackson dissented.
This will actually affect the status of around 600k Venezuelans and Haitians that Biden flew in at the last minute.
Whether Trumps decision was good or bad, at least this establishes that the Supreme Court recognizes that, even when it may disagree with the President, the court cannot play President.
They are recognizing limits to their own power in favor of the elected branches, and that is a good thing.
I thought this was an interesting quote from the VP:
“You cannot have a country where the American people keep on electing immigration enforcement and the courts tell the American people they’re not allowed to have what they voted for. That’s where we are right now,” Vance continued.
Isn’t Vance attacking the basis of our federal system? We have elected representatives and the electoral college to prevent “mob rule,” or people voting to violate the Constitution. That’s why we’re not a true democracy, I’ve been told. The role of the courts is to adjudicate the law, not reflect the ever-changing will of the electorate.
Radical LW judges have nothing to do with adjudicating the law. They need to be reined in. Best if you don’t attempt to cherry pick Vance’s comments, thereby creating a strawman argument.
Sometimes we agree with judicial decisions and sometimes we don’t. When we don’t, that doesn’t necessarily mean the judges are “activists,” and popular opinion shouldn’t affect their decisions.
