The remedy for the mistake is that Garcia will still be in El Salvador. Sure, he might come back to detention in the US for a couple of days. Following an immigration hearing to remove the withhold deportation order, he will quickly be returned.

And as far as checks and balances goes, the judge is/was a state judge. “Checks and balances” refers to the three branches of the federal government, not state judges, state legislatures or governors.

The judge still broke the law. Cases are dismissed all of the time as part of a plea deal. It doesn’t mean no law was broken.

In this case, the judge did break the law. That really isn’t in question. The only real question is how it will all play out.
