“§ 600.1 Grounds for appointing a Special Counsel.

The Attorney General, or in cases in which the Attorney General is recused, the Acting Attorney General, will appoint a Special Counsel when he or she determines that criminal investigation of a person or matter is warranted and—

(a) That investigation or prosecution of that person or matter by a United States Attorney’s Office or litigating Division of the Department of Justice would present a conflict of interest for the Department or other extraordinary circumstances; and

(b) That under the circumstances, it would be in the public interest to appoint an outside Special Counsel to assume responsibility for the matter.”

no. the statute authorizing the AG to appoint SP’s has been expired for a long time. Title 28 does not cover it.

but he may not appoint anyone that would require Senate Confirmation which a special prosecutor would.

lots of laughs. judge chutkan was ready to try trump on the election charges, until he appealed on presidential immunity NOT an illegally appointed SP to SCOTUS.

indicting a perp. and wanting to bring that person to trial is another way of looking at it though non partisan eyes.

Smith was the perfect selection for Garland. He had won a conviction against the Republican governor of Virginia by applying a law that the Supreme Court unanimously said wasn’t even relevant. But the Biden administration needed a conviction or at least an indictment before the election. It didn’t matter if the case was reversed after the election.
But the overkill of cases, all brought by Democrats, to prevent Trump from winning, became too obvious and failed in their purpose.
