Trump should pardon Manafort: Its fruit from a poisoned tree

Mueller’s investigation is founded upon false premises. It doesn’t have a criminal predicate. Therefore, everything the 13 angry partisan lawyers find, is fruit from a poisoned tree. Like throwing out evidence gained by illegal search and seizure, so are the charges against Manafort.

Let’s assume that there are actually 13 Democrats on Mueller’s team… Wouldn’t any finding report need to be blessed by Mueller (Republican) and Rosenstien (Republican)? If the report is full of accusations without evidence, then the right people would find out, no?

Alfie, would you have been ok with Obama ordering the DOJ to stop investigating Hillary, or giving her a pardon?

The logic requires Trump pardon everyone Mueller affected. Even the Russians. Fruit from a poisoned tree is consistently rejected by the courts. For example, not reading someone their rights, any confession they made after is thrown out. Failing to obtain proper warrants, all evidence thrown out.

Its irrelevant immaterial and incompetent to protest they are guilty, the evidence (including confessions) was obtained unconstitutionally, its fruit from a poisoned tree.

There is no “fruit of the poisonous tree” unless evidence was obtained unlawfully.

No criminal predicate for a special counsel, collusion is not a crime. Its a poisoned tree, and its fruit therefore, inadmissible. A violation of the constitution. A “super prosecutor” above the president is not in the Constitution. It therefore is unlawful.

There is no poisonous tree unless evidence was gathered unlawfully.

Fruit of the Poisonous Tree
The principle that prohibits the use of secondary evidence in trial that was culled directly from primary evidence derived from an illegal Search and Seizure.

The “fruit of the poisonous tree” doctrine is an offspring of the Exclusionary Rule. The exclusionary rule mandates that evidence obtained from an illegal arrest, unreasonable search, or coercive interrogation must be excluded from trial. Under the fruit of the poisonous tree doctrine, evidence is also excluded from trial if it was gained through evidence uncovered in an illegal arrest, unreasonable search, or coercive interrogation. Like the exclusionary rule, the fruit of the poisonous tree doctrine was established primarily to deter law enforcement from violating rights against unreasonable searches and seizures.

The name fruit of the poisonous tree is thus a metaphor: the poisonous tree is evidence seized in an illegal arrest, search, or interrogation by law enforcement. The fruit of this poisonous tree is evidence later discovered because of knowledge gained from the first illegal search, arrest, or interrogation. The poisonous tree and the fruit are both excluded from a criminal trial.

Assume that a police officer searches the automobile of a person stopped for a minor traffic violation. This violation is the only reason the officer conducts the search; nothing indicates that the driver is impaired by drugs or alcohol, and no other circumstances would lead a reasonable officer to believe that the car contains evidence of a crime. This is an unreasonable search under the Fourth Amendment to the U.S. Constitution. …

There are many and serious problems with this investigation but that isn’t one of them.

When Clinton pardoned Mark Rich tax cheat etc., some complained but no one disputed his right to do it.

Its not pertinent my opinions on pardon, Trumps constitutional power to pardon is absolute, only impeachment is the exception. That’s the constitution.

But back to the point. Just as a confession is thrown out because Miranda was not read, so also everything must be thrown out when there is an illegal “super prosecutor” usurping the constitution to violate the rights of Americans.

We have dominion, not the government. Its a government by the people for the people. Our rights supersede the Government.

OK then. If Trump could pardon himself, so could a President Hillary.

Likewise, Obama had the right to pardon her or order the DOJ to stop their investigation.

Just so we are being consistent.

If this story is true, then Manafort just made things even worse for himself.

So Manafort sent encrypted messages to former employees to encourage them to make “materially false” claims about his lobbying for pro-Russian Ukrainian politicians. While under house arrest!

Yeah, Manafort is probably going to exchange the ankle bracelets for a jail cell.

A special counsel requires a criminal predicate exist, collusion is not a crime therefore Mueller’s team of angry Democrats is a poisonous tree.

Trump should pardon everyone affected, then order Mueller’s coup end, release whatever he has and go home.

Yes. But there is a difference, Obama and Hillary are guilty of many crimes. Trump is not.

CNN? Haven’t they eventually retracted every click bait headline they posted on this issue? Yes, they did.

Sad Lefties on the edge of their seats, thinking Trump has fallen…each new CNN expose, only for it to fizzle.

Perhaps, but maybe Trump pardons all affected by Meuller ordering an investigation into the Establishment Coup attempt. Then the Mueller Rothstein Comey trinity might see jail time.

I love a good humorous fantasy to start my day!

BAC threads are always so entertaining. Always nice to start my day off with a good laugh - or 100.

If Obama and Hillary are guilty, why doesn’t Trump order investigations into their crimes?

Read this letter… https://www.justice.gov/opa/press-release/file/967231/download

Tell us which paragraph says he should investigate collusion…

They are covering up their own crimes, both Mueller and Rothstein his butt buddy were in on Unranium One
