Already happened. Federal court stated title IX was about sex, not subjective gender identities.
I’m not aware of what NY does to get it right.

because they were defeated in district court. its usually what is done when POTUS is defeated in lower court (trump does it all the time)

That is the wrong court case. We’re talking about Maine suing because Trump told 'em if they violated Title IX as it is currently interpreted, he would withhold Federal Funds from the State.

The principles are the same as to whether sex means sex or sex means subjective gender.
However, if neither is taken to the Supreme Court, the rulings won’t be determinative outside of the fifth circuit.
I understand that, but we were talking about the Governor of Maine suing because of the impending loss of Federal Funds over the Trump Title IX policy decision. That suit is about money.
