Yes, Garcia was mistakenly sent, but the US had nothing to do with his subsequent incarceration and the US has no say in what ES will do with him.

I’ve already provided evidence showing El Salvador asked Trump to send prominent MS-13 gang members from El Salvador back, as part of the deal they made. That was controversial, because the US was working to put together a case for some of those gang members in the US illegally.

Trump did end up sending 23 ES MS-13 gang members as part of the 261 detainees on those 3 flights to ES. Garcia was mistakenly among those 23 MS-13 gang members. ES explicitly asked for them. There was no reason for the US to pay ES to take ES MS-13 gang members, when ES explicitly asked for them in the first place.

So once again, if you have evidence showing otherwise, please feel free to share it.

Perfectly legal. He was in this country illegally.

Preventing meaningful contact with his family and attorney.

Providing no court access to challenge is detention.

No court access to challenge his transportation to an ES concentration camp - the one country in the world the administration was under judicial order (Judge Jones) NOT to send him to.

Loading him on a plane and sending him to ES in violation of a US Federal District (Judge Boasberg ) who ordered the flight to stop before it ever took off.

And US Marshalls turning him over to the concentration camp with no criminal charges either in the US or ES.

He was mistakenly sent to ES.

The key point is that once Garcia arrived, ES was free do do what they wanted with him. Unlike the 238 TdA gang members, the US didn’t pay ES to take Garcia, nor did the US pay to incarcerate him.

The odd thing about those who selected Garcia as their poster boy is that, unlike many others, he is an ES citizen. That means when it comes to primary jurisdiction over his location or status, ES wins hands down over the US. We are in no position to demand “return” of their citizen who is not a US citizen.
