From looking it up, that’s exactly what they should do. He is long past an expedited removal. I suppose they were trying to make some sort of point by not sending him to Costa Rica but that’s what they need to,do to make this incident history.

I thought I read teh judge is doubting there ever was a deportation order?
there was no removal order which is why he is was issued a TRO from being in ICE detention.
IJ issued one after his release at 7:01pm
next hearing is December 22, 2025 regarding a government appeal to his TRO.
