He’s out on bail re: the TN case. So not likely to be picked up for that.

Right now he’s free to walk around.

There remains almost two full weeks until Christmas.

For those that may need the link to the opinion. Below.

Interesting is the section thaet begins on PDF page 18 defining what a removal order is under the law, and how the government has failed to produce one in the Abrego Garcia case.

In 2019 the Immigration Judge withheld removal, and in all the years since the government has not filed a formal removal order to recind the 2019 withholding.

if they did the right way (which is almost impossible given the level of incompetence). garcia would be soaking up the rays in costa rica.

How can they deport someone without a removal order? <<<< that’s a serious question.

Do they now need an administrative judge to sign one?

Yes, it appears that since withholding was granted by an Immigration Judge in 2019, that the administration must go back to a judge and get the withholding lifted to then issue a valid deportation order.

From the opinion though, the administration has not done that and that such a request MUST identify the country where the individual is being deported to.

So we have:

  • Costa Rica - which was offered months, Costa Rica agreed, Garcia said he wouldn’t fight it, but the government removed the offer.
  • Ughanda - who said they wouldn’t take him,
  • Ghana - who said they wouldn’t take him,
  • Eswatini - who said they wouldn’t take him,
  • Liberia - who said they wouldn’t take him.

Until they can identify a country willing to take him for the deportation order, they are kind of stuck. (I mean they can alway go with the Costa Rica option, but they choose not to.) And until such order is issued, the Judge said, there is no basis to hold Garcia.

they now have a removal order signed yesterday at 7:01pm

however garcias lawyers asked for a TRO to block detention.
