The counterclaim here: That Carroll’s description of the event as rape was defaming. It was dismissed because the event was rape in any normal parlance, and in many other states.

Correct - but in what peek-a-boo routinely calls the court of public opinion, if someone places fingers in a woman’s vagina against her will we call that rape. In many states, it is officially rape.
