The “genuine risk of physical harm” will be twisted by lawyers who say “because of the defendant’s upbringing, he had no idea that armed robbery was wrong” or something stupid like that. Leniency like this will make these types of crimes increase. Also, what if someone uses a realistic-looking toy gun (for safety reasons) in a store and gets shot by the business owner in self-defense?

Absolutely sickening! The fact is robbery in the Second Degree is a Class C violent felony in New York and a person convicted of it is supposed to earn a minimum sentence of at least 3 1/2 years in state prison. An exception being one charged as a “Youthful Offender”.
