Personally I do not think it matters, changing the make up of the SC wont just āhappenā too much of a political risk.
If something like the reversal of Roe would occur then yes that would be a catalyst to change the supreme court.

If this situation were to happen. Biden should nominate an ultra-conservative Republican hard-liner. If McConnell accepts the nomination, he comes across as a hypocrite and Biden withdraws the nomination. If McConnell refuses, heāll face the ire of his own party.

We went from āprecedentā to āthe people should chooseā etc. The explanations evolved as holes got poked in the idiotic, flimsy rationalizations. Thereās no particular reason a SCotUS nominee shouldnāt even be CONSIDERED and given an up/down vote just because the presidency/senate are split. Young, idealistic law clerk McConnell once held that position when he wrote that itās the job of the senate to consider the presidentās nominee on their qualifications, not partisanship.

To my understanding, Breyer could be caught in bed with a live boy or dead girl, and we couldnāt do much to have him removed. Impeachment is the only recourse.
