That’s why I think we should increase SCOTUS to 13 members…starting now.
Repubs don’t do it…libs sure as hell will when they get a chance.
Next time they won’t have Sinema and Manchin standing in there way. I’m forever grateful of those two, otherwise supreme court would look lot different today.

It’s a concern when the court doesn’t provide guidances to the lower courts regarding its own decisions and the role of precedent in the emergency docket, nor does it follow its own precedent.
So many judges now are nothing more than political activists. Their decisions aren’t based on law but based on their political leanings.

How could they know if it’s based on law when the SCOTUS doesn’t inform them if an emergency order is precedent?
The sheer numbers of judges going against the historical authority of the POTUS and their criticism of the SCOTUS proves my point.

They aren’t “going against the historical authority” in significantly increased numbers. They are being asked to settle a wide range of unique questions of law.
How could they know if an emergency action is precedent when SCOTUS itself isn’t clear about it?
Really? Then why have so many already been overturned by appellate courts?

Are you of the opinion that an increased share of novel decisions have been overturned at the appellate level?
I’m of the opinion that the volume of cases involved, where by far the majority of the judges were appointed by a Democrat President or are Democrats vs the total number of judges, again proves my point.
