That article left out of the ruling that Sussman is not charged with a conspiracy so Durham cannot introduce evidence of one. Nor can the trial be about the accuracy of the data, or whether the collection of it was objectionable or legal, nor will there be a trial about any effort to disseminate the Alfa bank information.

So basically as the judge says.

I don’t think you guys are going to get what you want out of this trial.

Proposed jury instructions have been submitted.
A couple of interesting tidbits. Sussman wants the Prosecution to be referred to as Special Counsel instead of the Government.
There is also some dispute of how each side wants the summary of the indictment to be worded.
The text below is what Durham submitted as the summary. The bolded part is what Sussman wants added to the summary.

“The Indictment in this case alleges that, on or about September 19, 2016, Mr. Sussmann, did willfully and knowingly make a materially false, fictitious, and fraudulent statement or representation in a matter before the Federal Bureau of Investigation (“FBI”), in violation of 18 U.S.C. § 1001(a)(2), namely, that Mr. Sussmann stated to the General Counsel of the FBI that he was not acting on behalf of any client in conveying particular allegations.” concerning Donald Trump, when, in fact, he was acting on behalf of specific clients, namely, Rodney Joffe and the Clinton Campaign.”

The Judge ruled that 22 of the 38 emails in which Fusion claimed privilege, were not privileged and ordered the documents be provided to Durham.

However, due to the sloppy work on Durham’s part, he did not file his motion in a timely manner and he can not use the documents at trial.

sloppy work? he tried to get the documents 7 months ago for the grand jury.

He will get the documents, but if he wanted the documents for this trial, he waited to long to file his Motion to Compel.
He didn’t file it until April 6, 2022. The Judge decided that was to close to trial.

and he was in negotiations to get them until the end of january which the clinton camped used to stall. granted, he could have put in a motion in feb or march, but it ain’t like he wasn’t trying to get them.

I guess that means it’s all over now.

Today marks the third year of the Durham Investigation.

Not filing your motion in a timely manner is sloppy.

Maybe the other parties should be sanctioned for their stalling tactics.

He has so far gotten one conviction from Horowitz’s investigation.
