The latest batch of emails released from Hillary Clinton’s personal account from her tenure as secretary of state includes 66 messages deemed classified at some level, the State Department said early Friday. In response to Clinton’s request for a set of since-redacted talking points, Sullivan writes, “They say they’ve had issues sending secure fax. They’re working on it.” Clinton responds “If they can’t, turn into nonpaper [with] no identifying heading and send nonsecure.” Ironically, an email thread from four months earlier shows Clinton saying she was “surprised” that a diplomatic oficer named John Godfrey used a personal email account to send a memo on Libya policy after the fall of Muammar Qaddafi.
There is no question at all about the particular message cited here in which she directed her aide to remove the classified headers and send via unsecure email.
They have a classified system for such messages. She sent and received them outside of same.
Not only was she guilty of doing so, so too were those sending her the information.

Turn it into a non-paper means strip the classified information out. Regardless, the fax was never sent so there could be no “question” that the law was broken without a fax being sent.
The material was not “taken” from its proper place. It was originated entirely outside the classified information system.

If you take a document from it’s proper scan, copy, or otherwise reproduce and email it you have done just that.
Whether the aide complied, she ordered it showing she absolutely lied when claiming she had no knowledge of the marking systems.
“If they can’t, turn into nonpaper w no identifying heading and send nonsecure.” That’s an order to violate the laws handling classified material. There is no other way to read that demand. Regardless of whether or not Sullivan complied, this demolishes Hillary’s claim to be ignorant of marking issues, as well as strongly suggests that the other thousand-plus instances where this did occur likely came under her direction.
There is no doubt then that she knew what she was doing or her intent.

She certainly did, read the quote again. That alone would justify a conviction on perjury.
As for the rest, any prosecutor that could not successfully indict and convict her under the other statute needs to be unemployed.
