Text of Section 2: General Election Day
The general election shall be held biennially on the Tuesday next following the first Monday of November in each even- numbered year, but the General Assembly may be law fix a different day, two-thirds of all the members of each House consenting thereto: Provided, that such election shall always be held in an even-numbered year.
It does not set a deadline for when vote can be counted. Votes cast on election day are valid votes, such that those votes cast and in possession of the United States Postal Services (an organization of the United States Federal Government).
There is nothing in the PA Constitution that mandates an 8:00PM standard and as a matter of fact there is a federal law protecting overseas and military ballots mailed and postmarked by election day from being received and counted after election day.

Military and overseas vote counts have always been counted at a later date. Absentee ballots are to be postmarked to be received by Election Day.
The PA General Assembly did not vote to extend mail in ballots past the Nov 3rd (Election Day) deadline the Governor and AG enlisted a partisan judge to sign off on it usurping the authority of the General Assembly.
But who cares right? Itās been addressed by the USSC and 10,000 votes were āseparatedā.
No harm no foul huh, confidence in the system restored?
The ballots still had to be mailed by November 3rd and it wasnāt just a āpartisan judgeā**, it worked through the state courts to the PA Supreme Court who approved the revision made under emergency conditions because of the pandemic. We know itās a national emergency because President Trump signed the orders so stating.
They DID NOT extended the mailing deadline, they did allow legally cast votes on or before election day to be counted if in the possession of the USPS and delivered to election officials in a reasonable time frame.

Iām looking at the Sullivan/USPS case for hints about how election mail is handled.
This does not explain the truckload case, but the USPS expert (Kevin Bray) does outline in his declaration that certain extraordinary measures are applied to ballots.
The search is not limited to the interior of the plant and encompasses the surrounding area, including the docks and any trailers that might contain mail.

During the last days of the election, when all ballots must be dispatched from plants under the extraordinary measures undertaken by the Postal Service, all ballots retrieved during sweeps are expedited through whatever means are necessary to ensure they are delivered in time to be counted, assuming that is physically possible.

Any ballots identified in these sweeps were to be moved to the BoEs as quickly as necessary to be counted, outside of the Postal Serviceās usual transportation network. This includes arrangements with some BoEs who make plans to come to plants to pick up ballots themselves.

Today, I confirmed that the sweeps were carried out as instructed in plants located in the Central Pennsylvania, Philadelphia, Detroit, Colorado/Wyoming, Alabama, Northern New England, Greater South Carolina, South Florida, Lakeland, and Arizona districts.

There are many reasons that a ballot may not receive a finalization scan. Most delivery of ballots, we instructed plants to take ballots out of our normal processing (to āhold them outā) for expedited delivery to the BoEs (or organize for pickup by the BoEs). This process involves an expedited approach to sorting ballots by BoE on our processing equipment, and thus the ballots receive a first scan and are then removed, or āheld outā from further processing. This means they would not receive a finalization scan.
Note that the time of this declaration is NOV 4, so we have to extrapolate back to Oct 21 to imagine the process applied for this specific truckload.
Again, this is not an explanation for the truckload we are discussing, but we should keep in mind that the USPS was using unusual methods for handling ballot mail. Much of the driverās testimony focused on how unusual this truckload was being handled compared to every other day.
So we should keep this in mind as these extraordinary procedures might have come into play with regard to the 24 totes of ballot mail Originally destined for Harrisburg, then re-routed to Lancaster with involvement of a USPS facility director, then the trailer was no longer available to the driver for his normal route.
Power, and their fear of losing it, is more important to those spineless bootlickers. Heaven forbid they upset the orange one and say that Biden won the election.
Not much chance of passing now, but if they keep trying they should keep the provision where DMV address updates are propagated to the registration rolls. This keeps addresses More current than the otherwise would be.
I didnāt even know this was part of the original law, but it makes sense. At least from the perspective of accurate voter rolls.
But if the state legislatures or congress make an unconstitutional decision, the SCOTUS can have the final word on nullifying that unconstitutional decision. Thatās why they are there and well read on the constitution.
