1st Amendment and Schools - Punishment for Off Campus Social Media

What are your thoughts on current child abuse protocols?

Today, if a teacher notices signs of child abuse… they usually call the authorities or CPS.

Do you think schools should have that responsibility?

They have gone beyond that. Many school admins have let their limited power go to their heads.

They are mandated reporters by law. They didn’t give themselves that responsibility.

Maybe it happened. There are a lot of people who see a gun on a hip as a threat.

You advocate prior restraint, which is thought control and ascribes intent.

Bad choice.

Innocent until proven guilty of a violation

Should they be mandated by law to do that?

Noticed at school and call the law, yes.

There are many professions mandated by law to do that. In my state, everyone is mandated to report in regards to children even those outside of those specifically listed.

I don’t see why they shouldn’t be.

Hmmm… I tend to agree but I’m torn.

the alleged abuse happened off campus…

The result were noted on campus. The school isn’t suspending the parents or they child.

I tend to agree but I’m now struggling with the differences between mandatory reporting for child abuse off campus and not for racist comments off campus.

No but they are taking action on an off campus event.

Which one will land your ass in jail?

Reporting is neither determining nor punishing. Child abuse is illegal. Being a racist is not. In fact I have a right to be a racist.

No, they are reporting the presence of an injured child on campus.

Whether or not it is abuse will be determined by the appropriate authorities.

We just had thread here about a teacher reporting what they saw during a zoom call in the house. Most people thought she should have minded her business.

Why is reporting on POTENTIAL child abuse ok but not suspending based on off campus racist comments. The kids could have fell off their bike… hit with a baseball etc.

and your actions, other than that, pretty much.

The world has changed a hell of a lot since then.

Child abuse is a crime, being a racist is not.

Because what they saw was not abuse. It was an inanimate object.

They aren’t reporting POTENTIAL abuse. They are reporting an injured child.

They are legally bound to report evidence of suspected child abuse.

But that child could be injured by anything…
