This decision came on the Defendant’s motion to dismiss with prejudice. United States District Judge Sharon Johnson Coleman presided over the case.

Illegal immigrants cannot be deprived of their fundamental right to keep and bear arms merely for being illegal immigrants.

“Shall not be infringed” applies equally whether you are a citizen, national, legal resident alien or illegal alien.

Judge Coleman applied the historical arguments as Bruen commands and here we are.

She did not strike down the underlying statute, merely finding it unconstitutional as applied to the defendant.
