A 60-foot wide strip of land along three southwestern border states will be placed under the jurisdiction of the U.S. military to help deter illegal immigration, the White House said Friday.

A long sliver of federal land along the U.S.-Mexico border that President Donald Trump is turning over to the Department of Defense would be controlled by the Army as part of a base, which could allow troops to detain any trespassers, including migrants, U.S. officials told The Associated Press.

The transfer of that border zone to military control — and making it part of an Army installation — is an attempt by the Trump administration to get around a federal law that prohibits U.S. troops from being used in domestic law enforcement on American soil. . . . at least one presidential powers expert said the move is likely to be challenged in the courts.

As far as I am concerned the fact that the Army’s role is limited to such a narrowly defined strip of land means this is 100% legal, and not at all under the purview of the Posse Comitatus Act.

Moreover the Posse Comitatus Act is just that, and Act of Congress.
It is not part of the Constitution.

It can be amended any time Congress decides to, and in such narrow circumstances, should be amended if, by chance, I am wrong in my interpretation.

Building a new army base is definitely going to lower the price of eggs.

The federal government owns that land to defend the border and that is exactly what it is being used for.
No doubt formerly USAID funded think tanks are working tirelessly to figure out ways to be outraged over this.
