The hate crime makes ā€œcriminal mischief in the fourth degreeā€ into a felony instead of a misdemeanor.

Desecrating an American flag is protected speech.

On the other hand, desecrating a pride flag is a hate crime since it targets based on ā€œsexual orientation of a personā€.

Should have likewise been done for the BLM protesters who did the same on cop cars. The videos are out there.

Clearly taking some one elseā€™s flag is illegal.

On the other hand, the perpetrator has promise as an ā€œartistā€ who would have received government funding a couple of decades ago.

Yes, damaging someone elseā€™s property is generally illegal and not a good idea.

On the other hand, months of arson and destruction of businesses, homes, and churches resulted in very few felony convictions, but burning a pride flag resulted in a 15-year sentence.

Can you point to any case from the 2020 riots were a property crime resulted in a similar sentence?

Burning down a church is no big deal. Burning the wrong flag is.

That guy got into an argument at a bar, stole a churches flag, went back to the bar and burned it outside, and threatened to burn the bar down. But what about the looters! If youā€™re going to commit crimes try to blend in with a group?
