They are engaged in an international crime but are not within the territorial boundaries of any country, so nobody can arrest them. But there is no law that says vessels used to commit that international crime cannot be targeted and sunk. So if they don’t want to risk being killed, they should stay at the dock instead of taking their boats out to sea where they can be targeted and sunk.

Yes there is indeed a statute dictating that the President cannot use military force at his whim to execute people, whether criminals or not.
He can’t even do it after claiming they are members of a foreign terrorist organization.
The statute has been repeated in this thread at least twice.
The President does not have unilateral power over the military like that.
And such strikes are widely considered under international human rights laws to be extrajudicial killings.
And this is the whole problem, before we get a stupid “why are you on the side of drug smugglers” response.
The President’s legal justification for using military force as he has done is unfounded and dubious.
It doesn’t matter if we are 100% certain the people are drug smugglers.
There is no international (human rights laws) or national law (Maritime Drug Law Enforcement Act or Section 219 of the INA) that gives the Executive the power to kill them UNLESS there is an IMMINENT or IMMEDIATE danger.
He can’t do it. He has no delegated power or authority that lets him do it.
The fact that people support him while he does do it just shows there are those that are willing to cede yet another undelegated power to the President so they can feel “safe” or “tough”, I guess.
