The important thing is that the Supreme Court understood it and carefully used the word “facilitate” instead of ordering him to force the return of Garcia.

Obviously, you don’t understand the difference between effectuate and facilitate.

More importantly, SCOTUS made it clear that the judiciary hasn’t the authority to direct the President to effectuate Garcia’s return.

No one should be imprisoned without being convicted of a crime, US citizen or otherwise. The US government is responsible for Garcia’s imprisonment, along with hundreds of others, despite no criminal convictions. That’s why this thread is still alive.

238 TdA gang members were incarcerated at the administration’s behest. Garcia wasn’t.

Garcia was mistakenly sent with the 238, a mistake the administration has done nothing to correct. And you’re overlooking the main point. Garcia has been the media focus because the administration admitted it was a mistake to send him. But regardless of Garcia’s situation, the US government is responsible for imprisoning hundreds of other people, ostensibly for life, without a criminal conviction. That’s the problem. Deport them or convict them, don’t imprison them without a trial. We’re not a Banana Republic.

There were 238 TdA Venezuelan gang members and 23 El Salvadoran MS-13 gang members on those 3 planes. Garcia was mistakenly sent with the 23 MS-13 gang members. While those 23 were part of a negotiated deal, they weren’t part of the paid deal to incarcerate TdA gang members.

Yes, Garcia was mistakenly sent, but the US had nothing to do with his subsequent incarceration and the US has no say in what ES will do with him.

Using AEA 238 TDA gang members were deported and imprisoned as part of a paid 1-year contract.

Courts have since ruled that use of AEA was unlawful. Time will tell what happens when the 1-year contract expires.

You’re missing the point again. I assume it’s intentional. The US government imprisoned hundreds of people without convicting them of crimes. That’s the problem.

Don’t worry, guys. When the next Democratic administration imprisons members of the Proud Boys for their appearance and associations, I’ll speak up for them too.

They entered this country illegally, violating US law and are subject to deportation. Most have been arrested for committing crimes it’s how ICE, local Law Enforcement and DHS tracked them down. The topic is Garcia. His incarceration had nothing to do with the US government.

Yes, they should have been deported, I have no issue with that. But for imprisonment, we have to convict people of a crime in a court of law.
