Yea but we are talking about how pregnant women are hiring someone to “kill” their child. But only the “killer” can be sued. Why not the potential mother herself?
Yes the 7th Amendment specifically mentions damages under dispute.
That’s the key word…it’s the definition of a civil suit…DAMAGE.
It’s how standing is determined.
This is akin to me saying I could sue a criminal for murdering you…even though I never met you and was not damaged in any way, shape or form by your murder.
If you think this is the kind of civil system the founders had in mind…not sure what to say.

Prohibition(s) always backfire. Drugs, abortion, guns, pornography, soda, you name it.
It is wisest to conserve prohibitions, and the enforcement resources, for truly reprehensible behaviors and things: benzene in rivers, child rape and porn, trafficking in persons, poison gas.
