Supreme Court November sitting commences October 30th with a couple of high profile cases

There are a couple of cases on October 31st, second day of the sitting, regarding when and whether a public official can block a user from their PERSONAL social media accounts.

Vidal v. Elster, No. 22-704 [Arg: 11.1.2023]

Issue(s): Whether the refusal to register a trademark under 15 U.S.C. § 1052(c) violates the free speech clause of the First Amendment when the mark contains criticism of a government official or public figure.

This is the “Trump too small” case. :smile:

U.S. v. Rahimi, No. 22-915 [Arg: 11.7.2023]

Issue(s): Whether 18 U.S.C. § 922(g)(8), which prohibits the possession of firearms by persons subject to domestic-violence restraining orders, violates the Second Amendment on its face.

It will be very interesting whether the Supreme Court continues with an absolutist interpretation of the Second Amendment or steps back slightly. This could go either way in my opinion, as I think Roberts at the very least will step back and Barrett or Kavanaugh might be willing to step back here as well.

As has been the recent pattern, this sitting is very light on cases. Only 7 cases for the entire sitting.
