Red Flag Laws - What Could Go Wrong?

And it only states police or attorneys… nothing about nurses or doctors needing to verify their claims.

At least liberals are getting bolder about showing how they want to make it easier to seize firearms from people.

Is there a relevant difference between the text of this bill, and the usual ex-parte orders used in domestic situations? Should I be more concerned about red flag laws than family code laws? Should I be concerned about both?

Red flag:

Upon complaint on oath by any state’s attorney or assistant state’s attorney or [by any two police officers] police officer or other complainant who is a family or household member or a medical professional, to any judge of the Superior Court, that such [state’s attorney or police officers have] complainant has probable cause to believe that [(1)] a person poses a risk of imminent personal injury to himself or herself or to other individuals, [(2)] (1) the judge may issue a risk protection order prohibiting such person from acquiring or possessing a firearm or ammunition,

And Texas Family Code § 83.001

(a) If the court finds from the information contained in an application for a protective order that there is a clear and present danger of family violence, the court, without further notice to the individual alleged to have committed family violence and without a hearing, may enter a temporary ex parte order for the protection of the applicant or any other member of the family or household of the applicant.

(b) In a temporary ex parte order, the court may direct a respondent to do or refrain from doing specified acts.

There you go.

But you’re comparing a law from CT to a different law from Texas?

Texas is not a good example of respecting the right to keep and bear arms.
