Did someone say there was no problem with it? I didn’t see that. These people are clearly idiots with way too much time on their hands. I would just keep driving through their fake checkpoint.
Your response indictates you think neither one has the authority. At least that was the way I read it.
Federal law enforcment officers (ICE and CBP) do have the authority.
That is my opinion. I know that legally ICE can ask for proof of citizenship, but in my opinion they should only be able to do so with probable cause. By law, people are not required to carry proof of citizenship with them, so this seems like a legal gray area.
If some random chuckleheads want to play checkpoint brownshirt and volunteer as a potential masterpiece of modern road art that expresses the conflict between reality and stupid in vibrant shades of red and gooey grill chunks…far be it for me to deny the potential entertainment.

I actually like that idea. Let them harass the citizens who voted for it. Because there is zero chance that this clown show is stopping an ICE raid.
Now if it were me, I would tell the clowns in no uncertain terms. “I’m not answering any of your questions. You’re not stopping me and if you keep your dirty little rat claws off of me, nobody gets hurt.”
Judges like this are a problem, releasing illegal people who assault federal agents then ask why they were arrested again. They should have never been let go in the first place after assaulting someone.
