It looked like he intended to stab him in the neck. Thatās not where I would stab someone if I wanted to keep them alive.

Sure - itās a self-defense weapon, and thatās reflected in the charge.
The premise that he intended to murder Zeldin is pretty silly, though - and would be nearly impossible to prove.
