Kagan and Sotomayor have a written catfight in the Andy Warhol case

Kagan and Sotomayor have been anything but clones on the Supreme Court and today’s rather testy Andy Warhol opinion proves its.

Link to the Opinion of the Court and dissent in ANDY WARHOL FOUNDATION FOR THE VISUAL ARTS, INC. v. GOLDSMITH ET AL.

SOTOMAYOR, J., delivered the opinion of the Court, in which THOMAS, ALITO, GORSUCH, KAVANAUGH, BARRETT, and JACKSON, JJ., joined. GORSUCH, J., filed a concurring opinion, in which JACKSON, J., joined. KAGAN, J., filed a dissenting opinion, in which ROBERTS, C. J., joined.

Sotomayor wrote for the 7 to 2 majority, but both Kagan’s dissent and Sotomayor’s response to the dissent were certainly testy.

Additionally, this case, and others decided today, continue to show a court fragmented on anything BUT the so called conservative/liberal divide.

For example, Gorsuch and Jackson continued their little bromance today.
