You actually think that the courts would not throw it out? Maybe they wouldn’t, but they would decide how it works and there is nothing short of impeachment Congress can do about it.

Under what mechanism would they throw it out?

Who of standing would bring the case to SCOTUS so it could be ruled on by SCOTUS?
