Should have charged him with littering.

Littering doesn’t really capture the full horror of the feel of a sandwich against a ballistic vest or the smell of onions and mustard in the evening.

With a littering charge the guy could have ended up on the Group W bench.

In the strict sense of the legal definition I don’t think that misdemeanor assault was the wrong charge. People shouldn’t go around throwing stuff, however benign, at cops.

And if you accept that, than yes: this was nullification

That sandwich was a huge hurdle to overcome. If it had been anything hard, the may have gotten a conviction, but remember, assault does not require any physical contact let alone harm. They might have had a better chance of getting a conviction if nothing at all was thrown.

Of course it was. By the letter of the law, he assaulted the officer and interfered with him performing his duty … both are clearly criminal offenses. The Jury let him off because they saw it for what it was … Political Kabuki theater.
