This is an interesting case.

My guess is that the restriction doesn’t stand. Gov should be allowed to request the removal dis/misinformation that pertains to speech the government supplied.

The government should not be allowed to force compliance to their requests via government threats. (Like what Desantis did with Disney).

Oh please, they threatened these companies openly in congress if they didn’t do their censorship bidding. And no it won’t be struck down, at least not for long unless Democrats pack the Supreme court.

Also, show me the exact threat. I do have an example from Desantis. Which I’m sure you have issue with… but I’m looking for a threat from the federal government

Surely you recall the threat of removing or altering section 230 if more wasn’t done to “counter disinformation”? As for Desantis and Disney, yes I also have a problem with that. It’s one of the reasons he isn’t getting my primary vote.

He is trying to claim it’s a free speech issue if the government can’t say whatever it wants to social media. It’s laughable, the government doesn’t have any first amendment rights.

I recall ongoing discussions from both republicans and Dems regarding section 230 but I do not recall those discussions intersecting with disinformation on social media.

The government can say what ever it wants. That was never the issue.

If the government says “this vaccine is being released to the public on January 20th”

Can the government request removal or correction of misinformation if they see viral social media posts claiming that the vaccine is being release on January 1st?

And lets not forget, they weren’t censoring disinformation, they were censoring the truth. And as the judge said in his ruling, they were mostly targeting their political opposition.

No, it doesn’t.

The court disagrees. If it’s legal speech they aren’t permitted to try and censor it. Trying to do it by proxy is no different then trying to do it directly.

The government should be able to say if something they say is true or false.

They should also be able to request corrections from social media or media companies alike.

Then go write a new constitution. That’s also not all they were doing, telling them to take down an American citizens speech is not requesting a corrections, it’s a violation of the first amendment.
