The city had no warrant to hold him any longer so they released him, ICE asked for them to detain him without due process, they said no.

so your suggesting the state of New Jersey illegal detain someone at request of the federal government without due process?

Immigration is not complicated. Follow the rulesā€¦make them easier to follow if we mustā€¦just follow the rules.

If ICE had gotten a judge order to detain him they would have, but they didnā€™t they asked for him to be detained without due process.

The detainer wasnt ignored, it was incompleteā€¦

And they had 51 days to correct the detainer and never bothered to submit a correct oneā€¦

So due to ices incompetence 3 people were murderedā€¦

Due process is for US citizens.

Note the CITIZENS partā€¦

Due process means that all citizens are guaranteed certain rights even if they have committed crimes. They cannot be required to testify against themselves (5th amendment). They have the right to have an attorney if they cannot afford one, and to a fair, speedy and public trial (6th amendment). No citizen can be tortured, no matter how bad of a crime they have committed (8th amendment). In the United States, the concept of due process means that you are considered innocent, until you have been proven guilty in the court of law. You have the right to:

  1. A fair trial.

  2. Be told what crimes you are being accused of.

  3. Explain why you are innocent, including the right to present evidence and call witnesses.

  4. Know what evidence is being used to accuse you.

  5. Have the person accusing you in court.

  6. A court decision based only on the evidence provided in court.

  7. A lawyer, even if you canā€™t afford one.

  8. A punishment appropriate for the crime. You cannot be tortured or fined excessively.

  9. The court must keep a record of the trial and all the evidence, as well as make a written report explaining the reason for their decision.

*Due process can include many other rights, which are much more specific to certain types of cases and situations.

Not for monsters who prefer jail to the broken existence they fled.

You cannot asterisk your way to acceptance of a broken sanctuary policy.

These types of crimes are what the (quasi-legal) immigrants are supposedly fleeing and instead they are importing.

I guess the lawyers can hold their noses and collect some billable hours anyway.

asking for the federal government to get a proper warrant to have someone detained in jail isnā€™t a bad thing. unless you think the government should have the power to detain people without oversight.

Of course they are criminal policies, against society, and sanctuary city officials and their specific ā€œcriteriaā€ requirements to uphold a ICE detainer request need to be held accountable. Itā€™s disgusting but not surprising that liberal sanctuary city officials care more for power, aka ā€œvotesā€ then they do societyā€™s safety.

In this case they just ignored the ICE retainer request and Iā€™m wondering if they even notified ICE of their criteria requirements, probably not because the arrogance of liberals and Dems is that they are above Federal Law and can do whatever they want.

Another way to look at it is that they are releasing monsters with nothing to lose to prey on soft fat Americans that donā€™t deserve peace and law.

Just a matter of perspective and opinionā€¦

It is worth noting that this tangent is being engaged by a Canadian that probably enjoys having these monsters weeded out in the US before they can get too far north.
