What happens if they get rid of Gaetz? Do they have a special election? Does DeSantis appoint a replacement? Oops:

“According to the U.S. Constitution and state law, the governor of the state calls for a special election to replace the vacant House seat.”

Any special election would be held pretty speedily in Florida. DeSantis will likely waste no time in scheduling it.

Well in the short term it wouldn’t change the voting balance in the House since Gaetz was spite-voting against anything McCarthy wanted.

They have a horrible track record. They’ve been wrong so many times it would be hard to count and I hate math anyway.

On what legal grounds would Gaetz lose his seat?

There is none. It would be a legitimate action to remove him from the Republican caucus. There is no legitimate basis for removing him from congress and it would not be acceptable.
But he can’t really be stopped from meeting with the Republicans because the others who voted with him wouldn’t stand for it and if they were thrown out of the caucus, it would hand the House to the Democrats.

On what legitimate basis would it be right to expel him from the Republican caucus? Is free speech no longer allowed in that caucus?

It could be done on the same basis he got rid of McCarthy. Because they wanted to. There is no right to meet with the other Republicans. But it won’t happen.

That was not Gaetz’ basis. To get elected as speaker, McCarthy made comitments. He failed to keep his commitments and set himself up for a vote to vacate.
