Intent. In order to commit criminal trespass, you must either go onto property knowing that you don’t have permission to be there or remain on property after learning that you don’t have the right to be there.
Warning or notice required. In many states, laws require there be a warning that you aren’t allowed to be on property before you can be convicted for trespassing on the property
That is not true which is proven in your own post that says “Many States” not all.Many states you can not walk onto someones property and it does not even have to be posted to be considered trespassing. Here is Colorado for example: Colorado
Colorado no trespassing laws are found in Title 18 Article 4 Part 502 – 504 of Colorado’s Revised Statutes. Trespassing occurs when someone “knowingly and unlawfully enters or remains” in or on a property in which they don’t have authorization or license to do so. Trespassing can either be a felony in criminal situations or a misdemeanor in other instances. There is no specific language concerning “posted” signs or proper notice .
Where I grew up it meant don’t go on property if you didn’t know if you could. Falls under the catch all of “ignorance is not an excuse”. I don’t particularly like that because it seems to only apply to us civilians and not police.
