even if the DOJ get’s its way on this there is >0 protection for suspects,
but I don’t think it is enough.
Convince at least one third party (in our system that means a judge) that search and/or apprehension is being done on good grounds . . . or don’t do it.
The search is to apprehend a named individual. Either that person is there, or he isn’t. What role would a judge play? In that regard, illegal aliens are detained every day without need for a warrant to detain them.
Within the context of the AEA, there is nothing in the act stating a judge has any role. It is an alien enemies act, designed to swiftly remove a real threat.
I am picturing an ICE cop saying
“I have really really good reason to think this guy is here illegally . . . only, no one outside my immediate circle of friends will believe it.”

The democrats already passed laws in their blue states that allow cops to kick in my door and steal my property. If I try to stop them, they are allowed to shoot me. Remember those red flag laws that all you democrats pushed,
I am saying if they have a good reason to enter someone’s home
(someone who might just be a Puerto Rican whom they thought was a Dominican) then they should be able to convince a third party of that.
If they cannot convince a third party of that then probably their judgment is clouded and they should not doit.
You already gave away our rights with your passing of red flag laws. You haven’t clutch your pearls when cops kick in the door of some innocent citizen without a warrant. Take his property and when he tries to stop them, they shoot him. Hypocrite.
There are various classes of deportees, each with different handling procedures. With the DOJ memo, we are talking only about Tren de Aragua terrorists. Other than the required Habeas Corpus relief mandated by SCOTUS, there is no AEA requirement for any review.
