DOJ memo: "Reasonable belief' authorizes warrantless entry under Alien Enemy Act

Given the dynamic nature of enforcement operations, officers in the field are authorized to apprehend aliens upon a reasonable belief that the alien meets all four requirements to bevalidated as an Alien Enemy. This authority includes entering an Alien Enemy’s residence to make an AEA apprehension where circumstances render it impracticable to first obtain a signed Noticeand Warrant of Apprehension and Removal (Form AEA-21B).

Warrantless entry, barring exigent circumstances, is not acceptable.

“Reasonable” suspicion of the venezuelan bogeyman is not a good enough reason for the government to kick in my door without a warrant.

Democrats are willing to go along with deportations of illegal aliens, just not in any manner that would actually make it possible to return more than a small portion of the millions who have been allowed in without any basis for permanent residence.

The DOJ memo seems to indicate that DHS has already identified targeted members of Tren de Aragua. Any resident or workplace search will only take place if the targeted member has a strong likelihood of being in the location at the time of the search. The DOJ memo outlines precautions to minimize mistakes.

This isn’t about random warrantless searches hoping to turn up someone who might be Venezuelan.
