Dobbs & NYS Pistol & Rifle watch thread

Keep declining permits that don’t supply a “valid” reason.

Then someone whose permit was declined will sue in state court, and win.

Wouldn’t that be along the lines of a writ of mandamus?

AGs, Mayors

Ok. But that’s my point. What enforcement is there?

So they win in court…… the state still doesn’t grant the permit…. What then?

Then they carry their weapon anyway.

Individuals can pursue Writs of Mandamus in the Federal Courts to compel State officials to comply with the ruling and in the extreme, can seek contempt orders which could go up to and include the Governor, Attorney General and other positions and could potentially include jail.

Thanks. That’s more what I was looking for.

Basically: What prevents a state from going “so what, we don’t care what the court says.”

But she is now in charge of making sure the peasants can’t say anything bad about the political elites and their buddies so it’s all good.

Well, of course.

But either way, that’ll be the world we live in.

California and Hawaii have been in contempt for years.

red flag laws i believe would fit into the “affray” exceptions noted at the time of ratification. also the bond requirements for those who had demonstrated they could not act responsibly with the right.

this is sad, someone should tell doj once the court has made its decision, they don’t get a vote, they just enforce.
