Yes, that is a common excuse. The reality is that tourists or people here illegally are not guaranteed birthright citizenship under the constitution.

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

People who are here illegally are not subject to the jurisdiction of the government. Neither are people here as short-term visitors.

I hope this was a purely facetious statement. Otherwise it’s pure idiocy, devoid of logic or common sense.

There is an Amendment process for that.

I was told that Roe v Wade was in the Constitution, but it’s possible that this SCOTUS may disagree. In other words the Constitution is what 5 people in black robes say it is.

Of course they are subject to the jurisdiction of the US.

If they were not subject to the jurisdiction then the whole concept of immigration enforcement would be moot.

Deportations have plummeted under Biden:

If an non US citizen gives birth to a baby in the US the baby can be a US citizen, but the parents are not. We don’t deport citizens. The parents can take their baby with them when they go back to Their country or leave the baby here if they want the baby to grow up in the USA.

If they’re not subject to the jurisdiction of the Federal government, then how can the Federal government legally deport them?
