Congressional created agencies legitimacy

[plagiarized content removed]

FDR tried this and SCOTUS unanimously ruled against FDR.

It appears Trump thinks he is the CEO,or maybe even king. This attempt of a power grab is certainly not in line with the idea of the separation of powers.

What do MAGA and non MAGA cons believe? We have been a democratic republic for 230+ years. If Trump succeeds with a SCOTUS ruling, will we become more of an autocratic country?

What agencies?

Its probably iffy at best.

There is a limit to power that should be given to these agencies. If congress can set up agencies with executive power but not under the President, they have effectively created a fourth branch of government. The legislative, the judicial, the executive, and the independent agency.
The constitution does not allow for any branch other than in articles I, II, and III. Especially not another branch far removed from the voters.
Where is the line drawn in what is permissible? I will be waiting to read what the Supreme Court has to say.
And the independent agency allowed under FDR was supposed to be of limited powers I believe.
Democrats should be careful about what they want here. The concept may come back to haunt them sometime in the future.

No.
…

Anyway, you can surely see that there has to be a limit to authority Congress can give to an “independent agency”. If there were none, they could literally transfer every authority a President has to such committees and the authority granted a President by the constitution would be essentially revoked.

See 295 US 602 (1935). That case ruled the authority of the President to remove could be limited by congress if and only if the agency did not exercise significant executive power. If it did, congress could not prevent the President from removing the commissioner.

Of course, where congress has not tried to limit authority to remove, there is not even a question.

The Biden Administration rushed a spending frenzy, hiring frenzy, promotion frenzy, installment frenzy, with much of it targeted at undermining the next administration.

And they didn’t hide it – leaving plain and obvious targets starting with DEI departments, initiatives, grants, hires.

It’s why Trump is simply slicing off major chunks of “probationary” hires. They’re essentially the new hires. Just like when Mama comes into the room and doesn’t ask which kid broke the lamp, but simply grounds everyone. Slice off all the new hires. And terminate whole agencies and offices that are overrun with DEI and libbishness, and rebuild them anew if some of their services are necessary, without the polluted politics that were freely funded.

“Agencies”. They’ve morphed into bureaucracies. They need adult supervision to get back into shape. Boot camp. Drill instructors.

And the concept of “Congressional-created” or “Congressional-approved” is specious because most of what Congress has done for years has been approving continuing resolutions and omnibus bills without real vetting of the content.

There’s a new sheriff in town. And although the drunks and whores and rowdies still want to rule Main Street, after a few busted heads they’re gonna figure out that it’s time to shape up or leave.

Here’s what we’re really talking about. This only involves certain agencies called independent agencies.

Yes.
Just like Hairry Reed ‘helped’ the same way Trump with rapid SCOTUS filling with his Justices.
They need to remmember that they don’t want something to come back and bite them in the behind AGAIN.

Wasn’t that awesome !!! I just loved it.

That’s not civics. That’s government.

The education system intentionally conflated the two.

“Independent” from what?

Control by other branches of government, particularly the executive.

Then who controls them?

Themselves.

The following provides a good summary of what is really going on.

You know this argument, if you can call it that, personally looks more like frothing but to make the point.

This might hold weight if you had not just allowed millions upon millions of votes to be tossed out so you guys could install a candidate, literally nobody voted for or wanted. horrible harris.

Its amusing that the ones claiming Trump is a threat to democracy are also the only ones who subverted democracy.

You know both could be true. Just because Dems may be a threat to democracy doesn’t mean that Trump isn’t. It’s a lazy rebuttal.

The Dems primary process broke no laws. Even if it was undesirable.

Trump trying to keep himself in office by fraudulently attempting to install fake electors… that does break the law. And it’s undesirable.

See a difference?

No, it’s a factual rebuttal.

Dems - Trump is such a threat to democracy, that we need to trash democracy.

It’s a moronic train of thought.

LOL, the primary process was trashed along with millions of votes.

2020? How about get your head wrapped around 2025 where

Trump has the

Presidency
Senate
House

And won Bigly just as I predicted .

I forgot to post the link. Thanks.
