Can Trump assume emergency powers to deal with the invasion at our southern border?

What we are finally realizing is, those walls were never intended to actually stop illegal border crossings.

The Democrat and Republican Leadership have conspired, for 35 years, to keep the border opened, and today’s Bill continues to allow and encourage illegal border crossings.

No barrier is ever intended to stop crossings.

They are delay devices only. Everyone knows this.

@johnwk2 Are you going to weigh in on Safiel’s post or ignore it? He is arguably the best poster we have here when it comes to Judicial and Constitutional matters. What do you say in response to his take?

This is a screenshot from the third video you posted…

Looks like we are already strengthening that portion of the border… I think we can assume those companies constructing this have made sure there is funding for this construction. Now why do we need a national emergency?

And I’m sure if you ask Safiel, he will tell you under the 1976 national emergencies act the president can shift existing money already appropriated.

There are cameras everywhere… These people caught the staging of these videos…You have to watch this… fake news…

Show us where the NEA authorizes the President to become a king that can usurp the powers of the purse from the Congress.

I’m shocked frankly, that you are actually advocating for the Executive Branch to have powers that far exceed anything the Founders ever intended. You are advocating for the President to have the authority to declare any emergency they personally deem to be, and this declaration gives them the ability to override the will of Congress and become a unilateral, singular power without any checks on them by the rest of government.

But let’s ask @Safiel per your suggestion. Does the NEA allow the President to appoint himself as an unchecked super-power over the United States Government, including taking the power of appropriations away from the Legislative Branch? In your understanding of the act?

The Act allows the president to re-direct some specifically allocated funds.

JWK

And just think @johnwk2 the courts will be deciding how accurate your legal prognostications are real soon… First lawsuit has already been filed… :joy:

Hooray for a monarchy!! Presidents now can just randomly decide what they deem to be an emergency and then they can steal the appropriations power from Congress! Just as the Constitution and Founders intended. Woo Hoo!!

That whole separation of powers thing was overrated anyway. Nixon would have never had to resign if only he’d had the foresight to just ignore congress and declare himself king.

Exactly. I mean, this exact type of scenario is only one of the single greatest fears the Founders had when developing the checks-and-balances written in to our Constitution. Oh well, we had a good run I guess.

In case you missed it, our Founders mentioned invasion[s] three times in our Constitution and they specifically wanted the new government they created to “repel invasions”.

A very real problem, one that does not get the attention it ought to get is, we have domestic enemies, mostly socialists and communist wannabe leaders, who are hard at work trying to destroy America and the flame of freedom it represents. They have finally realized they cannot overpower America by force and have resorted to other tactics to destroy America. One tactic is to flood the United States with the poverty stricken, poorly educated, low-skilled, disease carrying and criminal populations of other countries. And that is why they have resisted securing America’s borders for 35 freaken years!

Make no mistake. There is a very real war taking place on American soil .

JWK

There is no surer way to weaken, subdue, demoralize and then conquer a prosperous and freedom loving people than by allowing and encouraging the poverty stricken, poorly educated, low-skilled, criminal and diseased populations of other countries to invade that country, and make the country’s existing citizens tax-slaves to support the economic needs of such invaders.

Get back to us when Congress declares this war as dictated by Article 1, Section 8, Clause 11 in the Constitution. This clearly states Congress must declare said war in order for the US to be in a state of war, and I’m quite certain I haven’t seen that declaration as of yet.

And you get back to us when the federal government’s obligation to repel invasions under Article 4, Section 4 is repealed and the President’s obligation to “preserve, protect and defend the Constitution of the United States” is repealed.

Why on earth are you so eager to allow the ongoing invasion of our southern border to continue? Do you not realize the devastating social and economic impact it is having in the United States, and especially is having in our nation’s inner cities?

JWK

Illegal immigration is now costing American citizens over $18 billion a year in healthcare costs alone! Far more than the measly $5.7 billion asked for to build a wall! LINK

There is no invasion. And that is not what the Founders intended in their concerns over is being at war with an invading nation’s armies.

We are watching the President attempt to shred a vital part of the Constitution right before our very eyes. No Executive should have unchecked, unilateral, king-like power over our government. The ability to steal land from landowners. The ability to appropriate funds Congress already appropriated. This is a broad-side attack on our very foundations of government.

Get back to us when this “invasion” begins.

It looks like @NebraskaFootball actually put it much more eloquently than I did here. Good reply.

You need to pay attention. The invasion has been taking place for 35 years and recently has accelerated:

Here the invaders are bum rushing the border of the united states:

and here they are crawling under the fence at the United States border:

and here they are climbing over the fence at the U.S. border:

Try paying attention to what is happening at our southern border.

So, Blue Tex, my “legal prognostications” were correct all along.

See: Dan Stein: Supreme Court ruling allowing Pentagon funding for border wall strengthens national security

“The Supreme Court was wise to side with the Trump administration Friday when it ruled that the president can use $2.5 billion in Defense Department funds for construction of a border wall to replace existing fencing in Arizona, California and New Mexico.”

JWK

The Democrat Leadership is correct! The border crisis has been manufactured. It has been manufactured by the Democrat Leadership in Congress refusing to protect our borders against an ongoing invasion.
