U.S. District Judge Matthew Kacsmaryk, a former religious liberty lawyer, found that a federal program that gives teens access to birth control denies a parent “a fundamental right to control and direct the upbringing of his minor children.”
Trump appointee.
This is interesting to me because of the quote at the end.
Do parents have “a fundamental right to control and direct the upbringing of his minor children”?
Does the state have a delegated authority to usurp this “fundamental right” of parents?
Are minors capable of consent? If so, why on this and not that?
From the first link:
“In a family planning setting, it is critical that adolescents have access to high-quality, confidential care from a provider who supports and respects their values,” Coleman said. “Title X-funded providers are considered highly trusted sources of health care information for their patients, and not being able to access confidential care will block a critical pathway to essential health services for young people.”
Emphasis mine. Says who?
WHO defines adolescence as 10-19. 10 years old. Is an 11 year-old capable of consenting to medication?
On the other hand, there is the reality of adolescent sexual activity/pregnancy. Due in no small part to the new sensibility.
What has caused pre-teens being sexually active to be “reality”?
I’m planning on putting my daughter on the pill when she starts with the red scare. Bad enough having to deal with that crap once a month, but soon twice? Lord have mercy.
I am not sure. It is the state preview for a child to receive proper medical care / be safe. But at what point does it trump the parents rights. It needs to be a high barrier to trump the parents. But where that line lies is difficult.
What? I don’t think I agree with that at all. Obvious exception being “safe” while in state custody such as school.
Does it ever “trump the parents rights”? Is it abuse to not provide contraception to adolescents? Is an 11 year-old capable of making informed consent? Who is monitoring for undue pressure?
What about child abuse cases? Keeping them in cages, starving them ect. If they are not in state custody it is OK? Should the state have authority to take them in custody and provide medical care?
Read above, stop with your little games. You were wrong there is a barrier. I showed it. You think a 11 year old who is raped might not need a contraceptive?
No, I don’t think an 11 year-old raped needs a contraceptive. I think they need an abortion and a gun. Unless we are planning to allow the rape to continue.
Is it the purview of the state to hide rape from the parents?
