This case is currently awaiting an en banc ruling by the full 4th Circuit. A three Judge panel dismissed this case for lack of standing, but it is expected to be revived by the en banc panel.

The District Court in this case initially dismissed the case for lack of standing, but a three Judge panel of the 2nd Circuit revived it and it is currently moving forward in District Court.

Blumenthal, et al v Trump is clearly dead and will certainly remain dead.
