Removing Qualified Immunity would stop all this stupid stuff. This Sherriff Deputy should not have qualified immunity since he committed battery on a citizen.
Initially the district dropped all charges against the victim, but since he hired a lawyer with intent to sue, they reinstituted the charges.
I hope this sheriff is fired. All LEOs should be required to hold a 1m(1,000,000) dollar bond. If they do something like this, the bond would pay out. If that were in place, these guys couldnt move to new districts because they wouldnt be able to afford the bond after doing something stupid like this.
All Police Officers should be Required to exercise de-escalation techniques.
Very often the police officers make the situation tense, and then complain about non-compliance. A citizen may have one interaction with a police officer in 10 years. It is a stressful situation for him/her. A police officer, has multiple interactions with civilians daily. They should be the ones to de-escalte the situation.
The first words out of the officers mouth should have been “Good Morning, We received a report about someone breaking into cars. Could I see your ID and did you see anyone in the area?”
No argument with that. And personally it’s a tense situation even when simply getting pulled over when I know exactly why I am getting pulled over. (Such as when I was 15 over through a speed trap.)
That doesn’t stop me from doing everything I can to get it over with as quickly and calmly as possible.
There are two sides of every encounter. The ones where cops overstep their physical contact boundaries almost always contain suspect resistance or belligerence. That’s all I was commenting on.
I agree with you that cops, as the power in the encounter, should take the lead for de-escalation. The LEO in the OP video took the lead in escalation, far too quickly than it should have been.
PS: Pretty good form on the take-down. I’ll bet he was a high school wrestler.
What did he do in none compliance that warrented that response? Pull away? No resist? No yell scream at him? No pull a weapon? No what did he do specifically? About the only thing he didn’t do was handcuff himself.
The officer had not authority to ask him to remove his back pack, nor did he have authority to take the back pack off him.
There should be no compulsion to comply to unlawful orders from LEO.
It also seems to me - meaning, where I that guy in that situation - the cop wanted the pack off so he could detain him.
I do understand your sentiment…like maybe, just go along and get it over with safely…but on the other ■■■■■■■■■that, you know? That guy with the pack was totally calm, not a threat in any way. If you can’t explain why your direction is lawful and necessary, get another job.
That guy showed no sign of resistance. There was nothing to de-escalate from. They both were very calm. HTat cop just wanted to â– â– â– â– someone up, so he did.
