A Conservative Judge Draws a Line in the Sand With Trump Administration

The above Order of the Court, a mere 6 pages in length, was issued on January 23, 2020. United States Circuit Judge Frank Easterbrook wrote for a unanimous panel, joined by United States Circuit Judge David Hamilton and Senior United States Circuit Judge William Bauer.

Basically, Judge Easterbrook tore Attorney General Barr a new ■■■■■■■■ In no uncertain terms.

Read all 6 pages of the decision. I cannot make things any clearer than Judge Easterbrook himself did. I agree fully with the decision, the tone of the decision and the reasoning behind the decision.

Attorney General Barr tried to outright defy the Article III Judiciary. Metaphorically, Judge Easterbrook delivered a right hook and knocked Barr out cold. Basically, he dealt with Barr in the only way that will get Barr’s attention.

Just peccadilloes.

You found 1 conservative judge with opinion? 1?

Are you sure Soros isn’t funding this Judge like others?

Wow…that was a remarkable smack-down. Well articulated and poignant.

We’re coming to the point of the president ignoring a Supreme Court ruling. But for a tearful plea from Condi Rice, it would have already happened in like 2006. Republicans will cheer when it does.

They dont care…you have to go to the maximum extreme to put them down. Judge should have thrown him in jail

What happened next beggars belief. The Board of Immigration Appeals wrote, on the basis of a footnote in a le]er
the A]orney General issued after our opinion, that our decision is incorrect.

This doesn’t beggar belief at all. This is the way things are now.

We have never before encountered defiance of a remand
order, and we hope never to see it again.

You will. Day after day.

The ephors don’t like being equal. Even “co-equal”. They hate being ignored.

They know nothing is gonna happen so they push. Someone has to push back full court.

Hmmm what would contempt entail and is this Judge providing the parties to now ask the Judges to consider contempt?

Members of the Board must count themselves lucky that Baez-Sanchez has not asked us to hold them in contempt, with all the consequences that possibility entails.

undocumented immigrant subject to deportation for committing a crime
guy applies for a special waiver to stay
immigration judge grants the waiver
board of immigration appeals revokes teh waiver saying only Barr can grant it
guy appeals to the 7th circuit witch disagreed with the board and remanded the case, ordering them to comply with the waiver.
They board refused…

teh judge,a very conservative judge, who justice scalia though would make a good replacement for himself issued an opinion ripping into trumps board of review sayng teh board is lucky the immigrant didnt ask for a contempt citation…

his exact words…

“We have never before encountered defiance of a remand order, and we hope never to see it again,” “Members of the Board must count themselves lucky that Baez-Sanchez has not asked us to hold them in contempt, with all the consequences that possibility entails.”

I beat you to this.

Ignore our laws, enter illegally and then get convicted of aggravated assault of a police officer…yeah…who cares?

Which does NOT give the Board of Immigration Appeal the right or excuse to do the same.

Lawbreaking never justifies more lawbreaking.

So only your guys can break the law. Got it.

They’re just setting the stage to ignore the Supreme Court rulings if they go against them.

Nope…put the illegal alien on the other side of our border. Then…enter legally. Let’s start there by abiding by our laws…shall “we”?

You’re ignoring the actual topic of this thread, because reasons.

How about a simple answer to the question at hand:

Do you believe that the AG and the President should have the power to ignore court orders they don’t like?

I’m sure there’s going to be a simple, clear and direct answer.
